1. Purpose
These Terms and Conditions of Sale govern the contractual relationship between Aloha Pixel, a micro-business specialising in the design, management and technical operation of websites, and its clients. They apply to all the services and products offered on www.alohapixel.com.
2. Legal information
Aloha Pixel is a sole trader business (micro-entreprise) operated by Justin Deboves, registered with the French national business register under SIRET 523 279 438 00031. Its registered office is at 6 Rue des Métairies, Porte 002, 64230 Poey-de-Lescar, France.
For any question: [email protected] or +33 9 85 03 43 20 (standard rate).
3. Acceptance of these Terms
Any order placed on www.alohapixel.com - whether a subscription or the purchase of a merchandise item - constitutes full and unreserved acceptance of these Terms. No specific condition of the client may prevail over these Terms, which constitute the sole contractual agreement between the parties.
4. Changes to these Terms
Aloha Pixel reserves the right to change these Terms at any time.
For new clients: the new conditions apply as soon as they are published on www.alohapixel.com.
For ongoing subscriptions: any substantial change to the Terms is notified by email at least 30 days before it takes effect. If the client refuses, they may terminate their subscription under article 12, with no penalty.
5. Severability
If a clause of these Terms is held invalid by a law, a regulation or a court decision, the other clauses keep their full force and effect.
6. Nature of the services
Aloha Pixel offers subscriptions for turnkey web services and organic search optimisation (SEO). These services include:
Website design: Development of bespoke showcase and e-commerce sites on WordPress/WooCommerce.
Optimised hosting: High-performance cloud infrastructure, with resources matched to each plan (see article 9).
Maintenance and technical management: Continuous monitoring, software updates, DNS management, security and performance supervision.
SEO:
Included in the website subscriptions (Start, Essential, Premium): service levels vary by plan, from basic optimisation to advanced monitoring with monthly reports.
Dedicated SEO subscriptions (Essential, Premium): search optimisation of existing sites, including audits, tag corrections, performance improvements and monthly monitoring reports.
Specific Premium services: The Website Premium subscription includes monthly strategic monitoring (60 minutes per month), proactive optimisations (continuous supervision and regular improvements) and automatic monthly reporting (traffic and conversion statistics).
Technical support: Help through email tickets under the terms detailed in article 18.
Environmental commitment: For every subscription taken out, Aloha Pixel adopts a coral in the client name through Coral Gardeners (adoption certificate provided). 1% of purchases is also given to Stripe Climate (contribution to funding carbon removal).
7. Specific SEO services
The SEO Essential and Premium subscriptions are dedicated to the search optimisation of existing sites, with no fixed term.
Setup fees: One-off fees charged at sign-up, covering the initial audit and the optimisations (up to 10 pages for SEO Essential, 30 pages for SEO Premium). They are non-refundable, subject, for consumer clients, to the exercise of the right of withdrawal under article 13.
Editorial content: The writing of copy and the creation of images are not included. Any editorial advice provided is advisory.
Results: Aloha Pixel applies industry best practice but does not guarantee ranking or traffic results.
Support included:
SEO Essential: 1 ticket per month, dedicated exclusively to SEO monitoring.
SEO Premium: 2 tickets per month, for full support with reports.
Each ticket corresponds to a maximum of one hour of work. Requests outside the SEO scope or exceeding this time will be invoiced separately.
8. Delivery of the services
After the order is validated, an Aloha Pixel advisor contacts the client within 48 working hours (excluding Sundays and public holidays) to define the requirements.
The site goes live within 10 to 15 working days of the order, provided the client promptly supplies the requested items (content, access, technical information). Any client delay beyond 48h releases Aloha Pixel from its responsibility for the delivery time. Once finalised, the site goes live with a ready-to-use admin interface.
Structured content writing included:
Website Start: 1 structured page with basic content (headings, menus, CTAs).
Website Essential: up to 10 structured pages with basic content and 15 e-commerce product sheets (title, short description, price).
Website Premium: up to 20 structured pages with basic content and 30 e-commerce product sheets (title, short description, price).
Any request beyond these limits will be handled through a support ticket or a separate quote. The features and content provided correspond strictly to the description of the plan taken out. Any service not mentioned will be the subject of a separate quote.
9. Hosting
Every subscription includes optimised cloud hosting. The allocated resources are as follows:
These resources are sized for normal use. In the event of overuse or excessive load, Aloha Pixel may propose an adjustment of the service (migration, price review, bespoke solution).
Cloudflare options: Advanced Cloudflare services (Pro, Business, Enterprise) are available on request and are the subject of a specific quote after the client agrees. They are disabled by default.
10. Domain name
Every subscription includes the registration of one standard domain name of the client choosing, subject to availability. During the subscription period, the domain name is registered in the name of Aloha Pixel for the sole purpose of technical management (DNS, renewals). The client is the beneficial owner of the domain and has the right to transfer it at any time on simple request, which confers full ownership of the domain on the client from the effective transfer.
On termination or at the client request, the transfer is free of charge to the provider of their choice. After the transfer, the client is solely responsible for managing and renewing the domain.
If the chosen domain is unavailable or exceptionally expensive, Aloha Pixel will propose an alternative or invoice the extra cost after the client explicitly agrees.
11. Intellectual property and ownership of the site
During the subscription: Aloha Pixel keeps exclusive ownership of the website (source code, design, content written by Aloha Pixel) until the 12th monthly payment is paid in full or until a full annual payment is made. During that period, the client has a right of use within the scope of the subscription, with no right of reproduction, modification or transfer to a third party.
After 12 monthly payments - or as soon as an annual payment is made: The client acquires full ownership of the site and of all the related intellectual property rights. Aloha Pixel then hands over a full backup (files, database, admin access, standard migration documentation), usable with any WordPress-compatible provider. Aloha Pixel provides no intervention or integration warranty outside its own hosting environment, except under a specific quote.
Plan changes and re-subscription:
The characteristics of the site (number of pages, product sheets, features) are set by the plan taken out at the time of the initial order.
If the client moves to a lower plan, or terminates and then re-subscribes to a different plan, ownership is only transferred after 12 consecutive monthly payments (or one annual payment) relating to the initial plan used to build the site.
No change of subscription before that point alters this rule.
Early termination: If the client terminates before the 12th monthly payment, they do not remain liable for the remaining monthly payments, but they lose access to the site (ownership of which has not yet been transferred). Amounts already paid remain acquired by Aloha Pixel, with no possible refund. The domain name is transferred free of charge on simple request, even in the event of early termination. The return of the client own content and data is governed by article 22.
Portfolio: By subscribing, the client authorises Aloha Pixel to present the site produced in its commercial portfolio (website, social networks, presentation material), including after the transfer of ownership. This authorisation may be revoked at any time by email to [email protected].
Non-contractual visuals: Visuals, mockups or demos presented before an order are illustrative and non-contractual.
Internal retention: Aloha Pixel reserves the right to keep a technical copy of the site for internal backup purposes, even after the rights have been transferred.
12. Term, renewal and termination of subscriptions
Aloha Pixel subscriptions have no fixed term. They are entered into for a period of one month (or one year in the case of annual payment), renewed by tacit agreement at each due date. The client may terminate at any time.
Termination by the client: Termination is free of charge and possible at any time:
online, from the Cancel your subscription page (always accessible from the site footer), which gives access to the secure customer portal;
or directly from the customer area: https://stripe.alohapixel.com/p/login/cNi14m7Ze1PG08g0Gybo400.
A termination confirmation is sent by email. Termination takes effect at the end of the current monthly billing period, with no refund of the month started (except when the right of withdrawal is exercised, article 13, and except for annual payments by consumers, refunded pro rata).
Termination by Aloha Pixel: Aloha Pixel may terminate the contract as of right, with 15 days notice given by email, in the following cases:
Behaviour amounting to harassment, insults or clear threats towards the Aloha Pixel team, duly documented.
Serious and repeated breach of these Terms.
Manifestly unlawful activity or use of the service contrary to public order and morality.
In the event of a serious breach requiring immediate action (security, legal risk), termination may be pronounced without notice. Amounts already paid remain acquired by Aloha Pixel.
Note on ownership: Full ownership of the site is conditional on the payment of 12 consecutive monthly payments or one annual payment, in accordance with article 11, including in the event of a plan change, a downgrade or a later re-subscription.
13. Payment and right of withdrawal
Sign-up fees: A one-off administrative fee of 99 € is charged in addition to the first monthly payment for website design subscriptions. SEO subscriptions have their own setup fees: 399 € for SEO Essential, 690 € for SEO Premium. These fees are always shown next to the subscription price, before sign-up.
Payment terms: Subscriptions are charged automatically through Stripe (bank card, PayPal, Apple Pay, Google Pay, Revolut Pay, Amazon Pay), on the same day of each month. If a renewal fails for technical reasons, the client is notified by email. Prices are expressed in euros (VAT not applicable, article 293 B of the French tax code: the prices displayed are the prices actually paid).
Annual payment: Clients may opt for an annual payment at a reduced rate, shown on each product sheet. The amount is charged in one go and ownership of the site is transferred as soon as that payment is made (article 11). For business clients, this amount is non-refundable in the event of early termination. For consumer clients, the monthly amounts corresponding to the unused months after termination are refunded pro rata, in accordance with the applicable regulations.
Late or missed payment: If a payment is not made and not settled within 15 days of a reminder, Aloha Pixel suspends access to the site. Suspension does not release the client from paying the amounts due. Late payment penalties (business clients): three times the legal annual interest rate in force, calculated from the due date until full payment of the price. Fixed recovery cost indemnity: 40 € (article L441-10 of the French commercial code).
Termination for non-payment: A payment delay of more than 30 days results in the termination of the contract as of right. Amounts already paid remain acquired by Aloha Pixel.
Right of withdrawal on subscriptions (consumer clients): A consumer client has 14 days from sign-up to withdraw, without giving a reason. By subscribing, the client expressly asks for the performance of the services (scoping, building the site, setting up the hosting, SEO work) to begin immediately, without waiting for that period to expire. If they withdraw within the 14 days while performance has started at their request, they are refunded the amounts paid, less an amount proportionate to the services already supplied up to the point their decision was communicated (article L221-25 of the French consumer code). The right of withdrawal is only entirely lost if the service has been fully performed before the end of the period, with the prior express agreement of the client and their acknowledgement of the loss of that right (article L221-28, 1°).
To exercise this right, the client may use, as they prefer: the online withdrawal function on the Withdraw from your contract page, the model form reproduced in article 28, or any other unambiguous statement sent to [email protected]. An acknowledgement is sent without delay. The refund is issued no later than 14 days after the withdrawal decision is received.
Clients living in France can register on the Bloctel list to opt out of telephone marketing: https://www.bloctel.gouv.fr/.
14. Price revision
Aloha Pixel may change its prices. Any price change is communicated by email at least 30 days before it takes effect. The client may terminate their subscription before the new price applies. Failing termination within that period, the new prices apply from the first monthly renewal following their effective date.
15. Client obligations
Compliant use: The client undertakes to use the services in accordance with the laws in force, good morals and professional ethics. Any abusive use (illegal activity, unlawful content, phishing, mass spam) may lead to the suspension or termination of the contract under article 21.
Accuracy of information: The client provides accurate and complete information at sign-up and informs Aloha Pixel of any change. Aloha Pixel cannot be held liable for the consequences of incorrect or out-of-date information.
Responsibility for content: The client is solely responsible for the content published on their site (text, images, videos, information). They warrant its compliance with the applicable legislation (copyright, GDPR, image rights, rules applicable to commercial, health or environmental claims) and respect for third-party rights. In the event of manifestly unlawful content, Aloha Pixel may suspend the services after email notification, without prejudice to proceedings by injured third parties.
Compliance with technical limits: The client uses the services within the scope of their plan (storage and bandwidth quotas). They must not attempt to exceed the allocated resources by indirect means, nor compromise the security or stability of the Aloha Pixel infrastructure (malicious code injection, spam, abusive storage). In the event of a breach, Aloha Pixel takes the necessary measures under article 21.
16. Aloha Pixel obligations
Quality of service: Aloha Pixel undertakes to provide its services professionally and diligently, ensuring that sites work properly and remain available. In the event of a technical incident, Aloha Pixel acts quickly.
Confidentiality: Aloha Pixel treats all client information confidentially and undertakes not to disclose it to third parties without authorisation, except where legally required.
Personal data protection: The personal data collected is used exclusively for the performance of the contract (subscription management, support, invoicing). The client has a right of access, rectification and deletion by contacting [email protected].
Subcontracting: Aloha Pixel may call on technical subcontractors (hosting, domain registration, email sending, print on demand) while remaining responsible for performing the contractual obligations towards the client and ensuring the confidentiality of the data processed.
Choice of technical providers: Aloha Pixel freely chooses its providers (Cloudways, DigitalOcean, GoDaddy, Cloudflare, Printful). Its liability is not engaged for malfunctions directly attributable to those third-party suppliers, save in the case of proven gross or intentional fault by Aloha Pixel and subject to the statutory rights of consumer clients (notably the strict liability provided for in article L221-15 of the French consumer code).
17. Maintenance, technical management and service management
Aloha Pixel provides the technical maintenance and day-to-day management of the client web services, including:
Routine maintenance: Security and stability software updates (WordPress, themes, plugins). Major updates or structural changes not covered by the subscription may be the subject of a specific quote.
Monitoring and interventions: Continuous supervision of the operation and security of the site. Automatic daily backup of the site, and one-click restore in the event of a major technical problem. Fast correction of any anomaly (outage, intrusion, critical bug).
Management of related services: Optimisation of DNS configurations, performance monitoring (speed, availability) and any necessary adjustments.
Right to intervene: Planned maintenance is announced by email 48h in advance. In an emergency (critical security flaw, attack, major outage), Aloha Pixel may act immediately without notice, even if this causes a temporary interruption. The client is informed as soon as possible.
Archiving: Aloha Pixel archives orders and invoices on a reliable and durable medium, in accordance with article 1348 of the French civil code.
18. Technical support - Customer service
Access to support: Through email tickets to [email protected]. A ticket number is assigned to each request.
Response time: First response within 48 working hours maximum (Monday to Friday, excluding public holidays). This is the time to first response, not a resolution guarantee or an SLA. If this time is exceeded without prior notice from us, the client receives a free support ticket.
Scope of support: Support covers the use of the site and the resolution of everyday incidents. It is not an unlimited development service. Requests amounting to new features or bespoke development are the subject of a separate quote.
Resolution time: The handling time depends on the nature and complexity of the request. If one client sends a high volume of requests, Aloha Pixel may stagger the handling within a limit of 10 working days, informing the client beforehand. Critical incidents (availability, security, transactions) are handled as a priority.
Tickets included in website subscriptions:
Website Start: 1 ticket per rolling 12-month period.
Website Essential: 2 tickets per rolling 12-month period.
Website Premium: 5 tickets per rolling 12-month period.
The rolling 12-month period starts on the initial sign-up date and renews automatically each year on the same anniversary date. Tickets not used during a period cannot be carried over.
If the plan changes (upgrade or downgrade), the ticket quota is adjusted immediately according to the new plan, but the anniversary date stays the same (initial sign-up date). In the event of termination followed by a later re-subscription, a new 12-month counter starts on the new sign-up date.
Pay-as-you-go tickets: For any request beyond the included quota or requiring additional work (content changes, adding pages or products, design changes, training, bespoke optimisations):
1 ticket: 89 € (1 hour of dedicated expert work).
Pack of 5 tickets: 399 € (a saving of 46 €).
Pay-as-you-go tickets have no expiry date. The client is informed before any additional invoicing. Several tickets can be combined for a longer request.
Tickets included in SEO subscriptions:
SEO Essential: 1 ticket per month, dedicated exclusively to SEO monitoring and optimisation.
SEO Premium: 2 tickets per month, dedicated to SEO monitoring and optimisation.
These tickets do not cover general technical requests. Requests outside the SEO scope require the purchase of pay-as-you-go tickets.
19. Warranties and limitations of liability
Aloha Pixel is bound by an obligation of means in the provision of its services.
Exclusions of liability: Aloha Pixel is not responsible for malfunctions resulting from:
The client use of incompatible third-party plugins or services, or incorrect handling.
External attacks (hacking, viruses, DDoS), despite the protections in place.
Hosting resources being exceeded because of exceptional traffic or saturated storage, unless an upgrade has been carried out.
Interruptions attributable to the third-party providers chosen by Aloha Pixel (Cloudways, DigitalOcean, GoDaddy, Cloudflare), save in the case of proven gross or intentional fault by Aloha Pixel.
Any quota imposed by a third-party provider being exceeded (for example the Cloudflare Enterprise bandwidth quota of 100 GB/month), the financial and technical consequences of which remain the sole responsibility of the client.
Limitation of liability (business clients only): In the event of proven loss attributable to Aloha Pixel, its liability towards a business client is strictly limited to the amount of the monthly payment made by the client for the period during which the loss occurred. This limitation does not apply to consumer or non-professional clients, nor in cases of wilful misconduct, gross fault or personal injury.
Indirect damages (business clients): Aloha Pixel cannot be held responsible for indirect losses (loss of turnover, loss of customers, damage to brand image) save in the case of gross fault or a serious breach that directly contributed to those damages.
20. Confidentiality
Aloha Pixel undertakes to treat confidentially all the information passed on by the client in the course of performing the contract, including access to former sites or hosts.
This information is used exclusively to carry out the services and manage the commercial relationship. No disclosure to third parties without the client prior consent is allowed, except where legally required (for example a judicial request).
These confidentiality undertakings remain valid after the end of the contract.
21. Suspension of services
Aloha Pixel may temporarily suspend - or permanently disable in the event of a serious breach - the services in the following cases:
Non-payment: A payment not made and not settled within 15 days of a reminder. The client is notified by email. If the non-payment continues beyond 30 days, the contract is terminated as of right. Amounts already paid remain acquired by Aloha Pixel; the client is not liable for the remaining monthly payments.
Breach of these Terms: Failure to meet an essential obligation (illegal use, unlawful content, technical limits exceeded). Suspension follows email notification of the breach. If the client does not remedy the breach within a reasonable time, Aloha Pixel may terminate the contract as of right.
Significant technical overuse: Substantial and unauthorised excess over the technical quotas (for example the Cloudflare Enterprise bandwidth quota of 100 GB/month). Immediate suspension without notice to protect the infrastructure. Restoration is conditional on the client putting things right technically and/or financially.
Suspension gives no right to compensation for the client when it is caused by their own breach. The service is restored as soon as the cause of the suspension disappears, in coordination with the client.
22. Retention, return and deletion of data
If the contract is terminated (by the client or for non-payment), Aloha Pixel keeps a copy of the site files and its database for 3 months after the end of the contract. During that period, the client may ask to retrieve the complete site (files, database, backups) for migration purposes, provided they have paid the first 12 monthly payments or one annual payment (article 11).
Client own data: Regardless of the ownership of the site, the content supplied by the client (text, images, documents) as well as the data for which the client is the controller (notably the order and customer data of their e-commerce activity) is returned to them on simple request, in a standard usable format, free of charge and with no subscription duration condition, within a maximum of 30 days.
After that 3-month period, all the site data (files, databases, backups) is permanently deleted, with no possibility of restoration.
23. Force majeure
Aloha Pixel cannot be held responsible for any delay or failure to perform resulting from an event of force majeure, notably: natural disaster, pandemic or epidemic, lockdown, major cybersecurity incident, general failure of telecoms or energy infrastructure, prolonged unavailability of essential cloud services or domain registries.
In the event of force majeure, Aloha Pixel informs the client as soon as possible and proposes, where possible, suitable solutions to ensure partial continuity of the service.
24. Right of refusal
Aloha Pixel reserves the right to refuse any subscription or service request before the contract is concluded in the following cases:
Serious doubt about the good faith or solvency of the client (history of fraud, unfavourable information).
A project contrary to the ethics or values of Aloha Pixel (advocacy of hatred, discrimination, manifestly illegal activity).
Any other legitimate reason assessed in good conscience by Aloha Pixel, where harm could result for the business or the client.
This right of refusal gives no right to compensation. If a refusal follows a payment, that payment is refunded in full.
25. Sale of merchandise
Aloha Pixel offers physical merchandise (Aloha Pixel branded clothing and accessories) through its site, in partnership with Printful (print-on-demand supplier). Aloha Pixel remains the client sole point of contact and is strictly liable for the proper performance of the order (article L221-15 of the French consumer code).
Delivery: Items are printed on demand and then shipped from the European Union. Unless stated otherwise on the product sheet, the indicative total time is 7 to 15 working days (production then shipping) and delivery takes place no later than 30 days after the order (article L216-1 of the French consumer code). Delivery costs are calculated and shown in the cart, before payment.
Right of withdrawal (consumer clients): 14 days from delivery to exercise the right of withdrawal, without giving a reason, through the Withdraw from your contract page, the model form in article 28 or an email to [email protected]. Products must be returned no later than 14 days after the notification. The client may handle the item to try it as they would in a shop; any depreciation resulting from handling beyond that may be deducted from the refund. Where possible, please reuse the original packaging. Return costs are borne by the client, except in the event of an error or defect on our side. Refund of the purchase price (including the original standard delivery costs, excluding return costs) no later than 14 days after the return or proof of shipment is received.
Return address: Aloha Pixel - Retours, 6 Rue des Métairies, Porte 002, 64230 Poey-de-Lescar, France.
Legal guarantees (consumer clients):
Information box on the legal guarantees (article D211-2 of the French consumer code)
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity should a lack of conformity appear. During that period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared.
The legal guarantee of conformity entails an obligation for the trader, where applicable, to provide all the updates needed to keep the goods in conformity.
The legal guarantee of conformity gives the consumer the right to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience for them.
If the goods are repaired under the legal guarantee of conformity, the consumer receives a six-month extension of the initial guarantee.
If the consumer asks for the goods to be repaired, but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.
The consumer may obtain a reduction of the purchase price by keeping the goods, or end the contract and be refunded in full against return of the goods, if:
1° The trader refuses to repair or replace the goods; 2° The repair or replacement of the goods takes place after a period of thirty days; 3° The repair or replacement of the goods causes major inconvenience for the consumer, notably where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods; 4° The non-conformity of the goods persists despite the seller unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction of the price of the goods or to rescission of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or rescission. The consumer is then not required to ask for repair or replacement of the goods first.
The consumer has no right to rescission of the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the guarantee that remained to run until the repaired goods are delivered.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French consumer code.
A seller who obstructs in bad faith the implementation of the legal guarantee of conformity incurs a civil fine of up to 300,000 euros, which may be raised to 10% of the average annual turnover (article L. 241-5 of the French consumer code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French civil code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept or to a full refund against return of the goods.
If a product is defective or non-conforming, contact [email protected] with photos of the defect. Return costs are covered by Aloha Pixel in that case.
26. Mediation and dispute resolution
Applicable law: These Terms are governed exclusively by French law.
Prior complaint: In the event of a disagreement, the client sends their complaint in writing to Aloha Pixel (email: [email protected] or post). Aloha Pixel undertakes to look for an amicable solution within a reasonable time.
Mediation (consumer clients): If amicable resolution fails, the consumer client may refer the matter free of charge to the Association Nationale des Médiateurs (ANM), of which Aloha Pixel is a member, within a maximum of one year after the initial complaint.
ANM Consommation contact:
Post: 2 rue de Colmar, 94300 Vincennes, France.
Email: [email protected]
Online form: www.anm-conso.com
The mediator helps to find an amicable solution. The parties are not obliged to accept the proposal and may end the process at any time.
Legal remedies:
Consumer clients: may bring proceedings, at their choice, before the courts having territorial jurisdiction under the French code of civil procedure (the court of the Aloha Pixel registered office, or the court of the place where the client lives or where the harmful event occurred).
Business clients: any dispute with a business client falls within the exclusive jurisdiction of the courts of Pau (France), even where there are several defendants or a third-party claim. A consumer client may bring proceedings before the court having territorial jurisdiction under the statutory rules of the code of civil procedure and the consumer code.
27. Credits, visual representation and artificial intelligence
Aloha Pixel uses various visuals to present its plans, products and services, including:
Images from official partners or suppliers (Coral Gardeners).
Creations from the Adobe® suite (Adobe Stock, Photoshop, Firefly, Express).
Visuals created with the help of artificial intelligence technologies (Sora by OpenAI, Gemini by Google).
The visuals on the product sheets and subscription pages are illustrative and non-contractual. Where a plan includes a concrete action (for example adopting a coral), the image shown is not a contractual representation of the actual result: the adopted coral may differ in shape, species, colour or planting location. Only the official adoption certificate issued by the partner NGO is authoritative.
The client acknowledges that some visuals are generated or stylised for aesthetic and symbolic purposes, and accepts this form of communication without reservation. No claim may be made on the basis of a difference between an illustrative visual and the reality of the service performed.
